TERMS OF SERVICE

2. Acceptance of terms

By creating an account on aichat.md, using our services, or interacting with the platform in any way, you confirm that you have read, understood, and agree to this document, the Privacy Policy, and the Cookies Policy. If you do not agree, please do not use the platform.

3. Service description

aichat.md is a SaaS platform that allows businesses to configure and operate conversational AI agents on channels such as Facebook Messenger, Instagram Direct, website widgets, Telegram, and others. The platform integrates AI models from third-party providers (OpenAI, Anthropic, Microsoft Azure OpenAI, and others), lead-collection tools, and CRM integrations.

4. User account

• To use the services you must create an account providing real, complete, and up-to-date information.
• You are solely responsible for keeping your authentication credentials secure.
• You are responsible for all activity that occurs under your account.
• We reserve the right to suspend or close accounts that violate these terms or are used abusively.

5. Subscriptions and payments

• Some features are available only through paid subscriptions. Current prices and plans are displayed on /pricing.
• Payments are processed through third-party providers (Stripe, bank, etc.). We do not store your card data on our servers.
• Subscriptions automatically renew at the end of the period unless cancelled at least 24 hours before renewal.
• Refunds follow the policy on /pricing or applicable legislation of the Republic of Moldova and the European Union (if you are a consumer).

6. Acceptable use

The following uses of aichat.md are PROHIBITED:

• Illegal activities or activities that violate third-party rights.
• Sending spam, harassment, threats, or disinformation.
• Generating illegal, pornographic, violent, discriminatory content or content violating Meta Platforms policies (Facebook, Instagram, WhatsApp).
• Automated scraping or attacking our infrastructure.
• Attempts to circumvent usage limits, payment systems, or security controls.

7. User content

You remain the owner of the content you upload to the platform (agent instructions, knowledge files, messages). By uploading, you grant us a limited, non-exclusive license to process this content strictly for the purpose of providing the service. We do not use your content to train AI models without your explicit consent.

8. End-user data processing

When aichat.md agents respond to end users (customers of our customers) on Facebook, Instagram, and other channels, their data is processed in accordance with the aichat.md Privacy Policy and the commitments of the respective platforms (e.g., Meta Platform Terms). End users can request data deletion through the procedure on /data-deletion.

9. Third-party platform integration

• Facebook and Instagram: use of integrations complies with Meta Platform Terms and Meta Developer Policies.
• OpenAI, Anthropic, Microsoft Azure: use of AI models complies with the respective providers' terms.
• You are responsible for complying with the terms of any third-party platforms you connect to aichat.md.

10. Limitation of liability

aichat.md services are provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, secure, or meet your exact expectations. To the maximum extent permitted by law, MEGA PROMOTING S.R.L. shall not be liable for indirect, incidental, special, or consequential damages arising from the use of the platform.

11. Changes to service and terms

We reserve the right to change features, prices, and this document at any time. Major changes will be notified by email or via a visible banner on the platform at least 30 days before taking effect. Continued use of the service after notification constitutes acceptance of the new terms.

12. Termination

• You may delete your account at any time through account settings or by writing to support@aichat.md.
• We may suspend or close accounts in case of violation of these terms.
• Upon termination, your data is retained according to the retention period in the Privacy Policy, then deleted or anonymized.

13. Governing law and jurisdiction

This document is governed by the laws of the Republic of Moldova. Disputes are first resolved amicably, and if no agreement is reached, they are submitted to the competent courts of Chișinău, Republic of Moldova. For users from the European Union, relevant provisions of EU legislation apply, including GDPR.
